R-1 (종교비자)

종교직에 종사하는 사람들은 종교비자를 고려해볼 수 있다. 전통적인 종교적 임무수행에 실질적으로 몸담고 이를 계속적으로 수행하는 것을 종교적 직책이라 볼 수 있다. 배우자나 만 21세 미만의 미혼 자녀들은 동반자 비자인 R-2 신청이 가능하다. 동반자들은 일은 할 수 없으나 풀타임 학업수행은 가능하다.

1. 자격조건

1) 종교비자를 신청하기 직전 지난 2년간 (또는 그 이상) 같은 교단의 종교단체의 멤버어야 한다. 종교비자 신청 바로 직전 2년간 같은 교단에서 일을 한 경력이 필요하지는 않다. 2년간 일한 경력은 종교이민을 통한 영주권 신청시에 필요한 사항이다.
2) 위 종교단체와 동일한 또는 연관성 있는 종교단체로부터 스폰서를 받아야 한다.
3) 스폰서를 서는 교회는 국세청으로부터 비영리종교단체로 세금면제자격을 인정받은 단체이어야 한다.
4) 종교직으로 스폰서를 받아야 한고 그 종교직을 수행할 수 있는 자격이 있어야 한다.
5) 종교단체는 급여를 지불할 수 있는 재정능력이 있어야 한다.

2. 변경된 종교비자 규정

1) 우선 미이민국을 통한 청원서승인 없이는 외국 소재 미국대사관을 통한 R-1, R-2 비자를 신청할 수 없다. 예전에는 이민국 승인없이 바로 해외 미 대사관을 통해 종교비자를 신청할 수 있었다.
2) 최종 결정 전에 종교기관이 실로 존재하고 job offer가 진짜인지를 증명하기 위해 현장 방문조사가 이루어진다.
3) 종교직종 (religious occupation) 이란 전통적으로 종교적 기능을 수행하는 직종으로 제한했다. 즉, 직업의 관행과 그 기능이 세속적인 종교기관의 멤버와는 구분되어 종교기관에 헌신하는 자가 신청할 수 있다.
4) 예전에는 종교비자의 경우 처음 3년 연장2년 총 5년을 부여했으나 이번에 바뀐 규정에 의하면 총 5년은 변함없지만 처음에 2년 6개월을 받고 연장을 통해 다시 2년 6개월을 받게 된다. 5년을 체류한뒤에는 적어도 해외에 나가 1년이 지난뒤 다시 종교 비자 신청이 가능하다.
5) 종교직을 수행하는데 필요한 교육정도와 훈련 정도는 규정하지 않았고 다만 고용주는 신청인의 종교직을 수행할 만한 자격이 된다는 것을 증명해야 한다.
6) 종교직에 고용된 사람의 고용관계에 변화가 있거나 고용관계가 끝이 났을 경우 고용주는 14일 이내에 이민국에 보고해야 한다.
7) 이번 규정이 시행되기 전에 접수되어 현재 펜딩중인 케이스도 개정된 법령의 적용을 받게 된다.


R-1, Religious Workers

The R-1 visa enables religious workers to enter the United States for five years or less. Religious workers include individuals authorized by a recognized employing entity to conduct religious worship and to perform other duties usually performed by authorized members of the clergy of that religion, and workers engaging in a religious vocation or occupation. The religious worker needs to demonstrate that he/she is coming to the United States solely to carry on the vocation of a minister of the religious denomination, to work for the U.S. religious organization in a professional capacity, or to work for the U.S. religious organization in a religious vocation or in a religious occupation. An applicant may qualify for a R-1 visa if the following requirements are met

• The applicant is a member of a religious denomination having a bona fide nonprofit religious organization in the U.S.
• The religious worker has been a member in the religious organization for the 2 years immediately preceding the time of his or her application for admission;
• The religious worker’s stay in the U.S. will not exceed 5 years and must intend to depart the United States at the end of their lawful status, absent specific indications or evidence to the contrary
• The religious denomination and its affiliate, if applicable, are exempt from taxation, or the religious denomination qualifies for tax- exempt status (such as 501(c)(3)); and
• The applicant has resided and been physically present outside the United States for the immediate prior year if he or she has previously spent five years in this classification. The R1 visa is initially valid for three years and may be extended for an additional three years.
