1. P-1 비자란?
P-1비자에 두가지가 있다. 하나는 국제적으로 인정받은 수준의 대회에 참가하기 위한 운동선수를 위한 P-1A 비자가 있다. 그리고 국제적으로 인정받은 외국에 기반을 둔 연예인 그룹의 연예인을 위한 P-1B 비자가 있다.
2. 운동선수를 위한 P-1A 비자의 조건
P-1A비자를 받기 위해서는 관련 단체로부터 추천서와 미국 주요 sports 리그나 팀과 맺은 계약서가 우선 필요하며 다음의 조건중 적어도 2가지는 만족시켜야 한다.
다음 중 적어도 3가지를 만족시킬 수 있는 경우;
1) 관련분야에서 국내 혹은 국제적으로 인정받은 상을 받은 증거
2) 관련분야에서 국내 혹은 국제적으로 인정받은 탁월한 업적을 요구하는 협회의 회원
3) 지원자 혹은 지원자의 업적이 전문적인 유명 저널이나 미디어에 실린 경우
4) 관련분야에 다른 사람의 업적을 평가하기 위한 심사관으로 참여한 증거
5) 지원자가 과학, 학술, 비즈니스 분야에 상당히 중요한 기여를 한 증거
6) 전문 저널 혹은 미디어에 논문이 실린 경우
7) 뛰어난 명성이 있는 조직이나 기관에 중요한 직책으로 고용된 증거
8) 지원자의 서비스에 대해 높은 급여를 받았거나 앞으로 받을 거라는 증명
3. 연예인을 위한 P-1B 비자의 조건
P-1B 비자란 상당기간 동안 국제적으로 뛰어난 것으로 인정받은 외국에 기반을 둔 연예인 그룹의 구성원으로 공연하기 위해 오는 외국인에게 주어지는 비자로서 그 외국인은 연예인 그룹과 적어도 1년 정도는 관계를 유지한 자 이어야 한다. 이 비자를 받기 위해서는 개인이나 연예인 그룹이 관련 분야에서 뛰어난 업적을 이룬것에 대해 국제적으로 인정받은 상을 받았거나 후보로 지명된자 아니면 다음의 다섯가지중 적어도 3가지는 만족시켜야 한다.
1) 외국인이나 그룹이 뛰어난 명성을 갖춘 이벤트나 작품에서 주연급으로 활동했거나 혹은 활동할 예정인자
2) 관련분야에서 뛰어난 업적으로인해 국제적으로 인정을 받은자
3) 상당한 상업적 성공을 거둔자
4) 관련분야 비평가, 기관, 정부기관, 전문가들로 부터 상당한 인정을 받은자
5) 관련분야 비슷한 다른 사람보다 상당히 높은 보상을 받을 수 있는자
4. P-3 비자
미국과 상호교환 프로그램 하에서 개인 혹은 그룹의 일부분으로 공연하러 오러 오는 외국인에게 부여되는 비자이다.
5. P-3 비자
예술 혹은 연예분야에서 문화적으로 독특한 프로그램을 개인적으로 혹은 단체의 일부로 공연하거나, 가르치러 미국에 올 경우 발급받는 비자이다. 이때 그 공연이 문화적으로 독특함(uniqueness)을 서류상으로 증명해야 한다.
6. P비자의 특징
1) 연예인의 경우에는 개인적으로 공연하러 오는게 아니라 그룹의 일원으로 신청해야 한다. 단 운동선수의 경우에는 개인으로 신청이 가능하다.
2) 여러 고용주를 위해 일하는 것이 가능하다. 하지만 그때마다 새로운 청원서를 이민국으로 부터 승인받아야 한다.
3) 배우자나 21세미만 미혼자녀들은 학업은 가능하지만 일은 할 수 없다.
4) 운동선수나 거기에 필요한 보조 요권들은 5년까지 체류할 수 있으며 연장을 통해 최고 10년까지 거주할 수 있다. 그외에는 처음 5년을 받고 그 이후 1년씩 연장을 통해 최고 10년까지 체류가능하다.
P-1, Entertainer/Athlete)
The P-1 visa is available for athletes and entertainers with international level recognition to enter as non-immigrant for up to five years. In order to qualify for this Visa, the performance or event must require a performer of international quality and must demonstrate a high level of achievement in the field evident by a degree of skill and recognition substantially above that ordinarily encountered, to the extent that such achievement is renowned, leading, or well-known in more than one country.
P-1A Visa – Professional Sports Players and Athletes Visa
Athletes qualifying under this category will need to demonstrate that they are internationally recognized and are preparing for competition or participation in an athletic competition or athletic league with a stellar reputation. To qualify for a P-1A Visa the alien must be able to submit at least two of the following:
• Evidence of significant participation in a prior season with a major United States sports league;
• Evidence of having participated in international competition with a national team;
• Evidence of having significant participation in a prior season for a U.S. college or university in intercollegiate competition;
• A written statement from an official of the governing body of the sport, which details how the athlete or team is internationally recognized;
• A written statement from a member of the sports media or a recognized expert in the sport which details how the athlete or team is internationally recognized;
• Evidence that the athlete or team is ranked, if the sport has international rankings
• Evidence that the athlete or team has received a significant honor or award in the sport.
P-1B Visa – Entertainers Visa
The entertainers qualifying for P-1B Visa include musicians, dancers, circus personnel, singers and most other types of performance groups. The entertainer group must have at least two members and seventy-five percent (75%) of the entertainment group must have been performing together for at least one year. Additionally, the entertainment group must provide evidence that the group has international recognition by submitting at least two of the following documents:
• Evidence that the group has performed, or will perform, as a starring or leading entertainment group in distinguished productions or events
• Evidence that the group has achieved international recognition and acclaim for outstanding achievement evidenced by reviews in major newspapers, trade journals, magazines, or other published material
• Evidence that the group has performed and will perform services as a leading group for distinguished organizations and establishments
• Evidence that the group has a record of major commercial or critically acclaimed successes.
• Evidence that the group has achieved significant recognition for achievements from organizations, critics, government agencies, or other recognized experts
• Evidence that the group has achieved international recognition and acclaim for outstanding achievement evidenced by reviews in major newspapers, trade journals, magazines, or other published material
• Evidence that the group has commanded a high salary or will command a high salary or other numeration for services.
