O-1, Persons of Extraordinary Ability

The O1 visa is designated for aliens of extraordinary ability in the sciences, arts, education, business or athletics. “Extraordinary ability” means that the alien has reached a level of expertise indicating that he/she is one of a small percentage who have risen to the very top of his/her field of endeavor. In addition, the position the alien is coming to fill must require the services of an individual of extraordinary ability. Typically, the foreign national must have either received a major international award such as the Noble Prize.

The alien must be able to present at least three of the following requirements:

1. Receipt of nationally or internationally recognized prizes or awards for excellence in the field.
2. Membership in associations in the field that require outstanding achievements.
3. Authorship of scholarly articles in major media outlets.
4. Published material in professional or major trade publications or major media about the alien’s work.
5. Participation on a panel, or individually, as the judge of the work of others in the same field as the alien’s.
6. Original scientific or scholarly contributions of major significance to the field proved by five or six letters and affidavits from prominent colleagues who can confirm applicant’s work.
7. Current or past employment in a critical or essential capacity for organizations and establishments that have a distinguished reputation.
8. Evidence of commanding high salary or other enumeration for service.

There is no prevailing wage requirement, the O1 visa may be extended indefinitely and there is no numerical limit to the number of O1 visas issued.
