K-1, Fiancé Visa

K-1 visas permit U.S. citizens to bring their foreign fiancés into the United States in order to marry. Only US citizens may petition the INS to allow his/her fiancé (e) to enter the U.S. on a K-1 visa for the purpose of marrying the petitioner. The petitioner and beneficiary must enter into marriage within 90 days of entry into the United States and apply for permanent residency. In order to qualify a K-1 visa, the following requirements must be met:

• The petitioner must be a U.S. citizen
• Both you and your foreign fiancé are free to get legally married.This means that both the petitioner and the alien fiancé(e) are unmarried, or that any previous marriages have ended through divorce, annulment or death
• The U.S. citizen petitioner and the alien fiancé(e) must have meet in person within the last two years preceding the filing of the petition.( This requirement can be waived only if meeting your fiancé(e) in person would violate long-established customs, or if meeting your fiancé(e) would create extreme hardship for you.)
• Both the petitioner and his/her fiancé(e) have intentions to marry within 90 days of your fiancé’s arrival in the U.S.
• he petitioner meets the minimum income/financial requirement
• The petitioner’s fiancé (e) does not meet any criteria that render him/her inadmissible to the U.S.
